Terms and conditions for "Gift wrapping" service

TERMS AND CONDITIONS FOR THE "GIFT WRAPPING" SERVICE
in the online store www.kopyto.com

§ 1. General Provisions

  1. These terms and conditions (hereinafter: "Terms and Conditions") set out the rules for using the additional "Gift Wrapping" service (hereinafter: "Service"), offered by the Seller to Customers placing Orders in the Store.
  2. The Service is provided by Z Kopytem spółka z ograniczoną odpowiedzialnością with its registered office in Sopot, ul. Władysława Łokietka 46/1, 81-736 Sopot, Poland, KRS: 0000617134, NIP: 5851474404, REGON: 364408532, BDO: 000635824, email address: sklep@kopyto.com (hereinafter: "Seller").
  3. These Terms and Conditions for the Service form an integral part of the Terms and Conditions of the Store of Z Kopytem sp. z o. o., available at: https://kopyto.com/policies/terms-of-service (hereinafter: "Store Terms and Conditions"). In matters not regulated by these Terms and Conditions, the provisions of the Store Terms and Conditions shall apply accordingly.
  4. The Service is optional and may be selected exclusively at the time of placing an Order.

§ 2. Definitions

For the purposes of these Terms and Conditions, capitalised terms have the meanings assigned to them below or — where not defined below — the meanings assigned to them in the Store Terms and Conditions.

  • Customer – a natural person, legal person or organisational unit making a purchase in the Store, as defined in the Store Terms and Conditions.
  • Consumer – a Customer who is a natural person performing a legal transaction not directly related to their business or professional activity; an Entrepreneur with Consumer Rights, as defined in the Store Terms and Conditions, shall also be regarded as a Consumer.
  • Sales Agreement – a distance agreement for the sale of a Product concluded between the Seller and the Customer, on the terms set out in the Store Terms and Conditions.
  • Product – a movable item that is the subject of the Sales Agreement concluded through the Store, in respect of whose purchase the Service was acquired.

§ 3. Scope of the Service

  1. Under the Service, the Seller prepares selected Products from the Order as a gift — in gift packaging available in the Store's offer at the given time.
  2. One Service order covers the preparation of one gift set. In order to wrap a greater number of separate gifts within a single Order, the Customer is required to add the corresponding number of Services to the Cart.
  3. The Customer may indicate in the "Order notes" field which Products are to be wrapped in the individual gifts. The indication may also be made by email to sklep@kopyto.com until the Order is handed over for packing.
  4. In the absence of an indication as to the allocation of Products, the Seller shall exercise due diligence to carry out the Service in an aesthetically pleasing manner appropriate to the nature of the Products. If, in the Seller's assessment, the absence of an indication makes it impossible to perform the Service correctly, the Seller may contact the Customer to obtain the necessary information.
  5. The gift packaging used by the Seller corresponds to the current offer and may be subject to seasonal changes. The Service does not include the creation of personalised dedications, cards or additional decorative elements, unless the Seller expressly offers such an option in the description of the Service.

§ 4. Price of the Service

  1. The price of the Service is:
    • PLN 19 gross — for small gift packaging;
    • PLN 29 gross — for large gift packaging.
  2. The price of the Service is added to the Order value as a separate item and is visible in the Cart summary before the Order is placed.
  3. The prices are gross prices and include VAT at the applicable rate.

§ 5. Right of Withdrawal

  1. A Customer who is a Consumer has the right to withdraw from the agreement relating to the Service within 14 days of its conclusion, without giving any reason and without incurring any costs, subject to section 5.
  2. The declaration of withdrawal from the agreement may be submitted in any form, in particular:
    • in writing to the address: Z Kopytem sp. z o. o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland;
    • electronically to: returns@kopyto.com.
  3. To comply with the deadline, it is sufficient to send the declaration before its expiry. The Customer may use the template form available at: https://kopyto.com/en/pages/returns-exchanges-complaints; the use of the form is not mandatory.
  4. The Seller shall refund the fee for the Service to the Customer without undue delay, no later than within 14 days of receipt of the declaration of withdrawal, using the same payment method that the Customer used when placing the Order, unless the Customer expressly agrees to a different method of refund.
  5. The right of withdrawal does not apply in respect of the Service where it has been fully performed, if the Customer — prior to the commencement of performance of the Service — expressly requested its immediate performance and acknowledged that they would lose the right of withdrawal upon full performance of the Service, in accordance with Art. 38(1) of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2024, item 1796, as amended; hereinafter: the "Consumer Rights Act").
  6. The request referred to in section 5 is expressed by the Customer by actively ticking a separate checkbox in the Order form, bearing the following content:

    "By choosing this service, you consent to the immediate commencement of the 'Gift Wrapping' service before the expiry of the 14-day withdrawal period and acknowledge that upon full performance of the Service by the Seller, you will lose your right to withdraw from the agreement in respect of this Service."

  7. Withdrawal from the Sales Agreement for the Product does not automatically constitute withdrawal from the agreement relating to the Service. If at the time of submitting the declaration of withdrawal from the Sales Agreement the Service has not yet been performed, the Customer may simultaneously withdraw from the agreement relating to the Service — in compliance with the deadline referred to in section 1 — and the fee for the Service shall be refunded in accordance with the terms set out in section 4.

§ 6. Complaints

  1. The Customer has the right to submit a complaint concerning the non-performance or improper performance of the Service.
  2. A complaint may be submitted in any form:
    • in writing to the address: Z Kopytem sp. z o. o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland;
    • electronically to: returns@kopyto.com.
  3. The complaint should contain at least: the Customer's name and surname, the Order number, and a description of the objections concerning the manner in which the Service was performed.
  4. The Seller shall respond to the complaint without undue delay, no later than within 14 calendar days of its receipt, on paper or on another durable medium. Failure to respond within the above deadline shall be deemed to constitute acceptance of the complaint as justified.
  5. A complaint may not be based on the Customer's subjective aesthetic preferences unrelated to the quality of the Service's performance, for example preferences as to a specific ribbon colour from among the available options. A complaint is, however, justified in particular where:
    • the packaging is damaged or aesthetically unacceptable without justification;
    • the scope of the Service performed is inconsistent with the packaging variant ordered;
    • the Service was not performed despite the fee having been charged.

§ 7. Final Provisions

  1. These Terms and Conditions are available on the website www.kopyto.com.
  2. The Seller reserves the right to amend these Terms and Conditions for legitimate reasons, in particular in the event of changes to applicable law or changes to the terms of provision of the Service. Amendments shall not affect Services acquired prior to the date on which the amendments enter into force.
  3. The Seller shall notify Customers of any amendment to these Terms and Conditions by publishing the updated version on the Store's website.
  4. In matters not regulated by these Terms and Conditions, the provisions of the Store Terms and Conditions and generally applicable law shall apply, in particular:
    • the Consumer Rights Act;
    • the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2025, item 1071, as amended);
    • the Act of 18 July 2002 on the provision of services by electronic means (consolidated text: Journal of Laws of 2024, item 1513, as amended).
  5. These Terms and Conditions are in force from 18 May 2026.
