TERMS AND CONDITIONS FOR GIFT CARDS

I. GENERAL PROVISIONS

These Terms and Conditions set out the rules for the sale, issuance and redemption of Gift Cards in the Online Store www.kopyto.com, operated by Z Kopytem spółka z ograniczoną odpowiedzialnością with its registered office in Sopot, Poland, ul. Władysława Łokietka 46/1, 81-736 Sopot, KRS: 0000617134, NIP: 5851474404, REGON: 364408532, BDO: 000635824, email address: sklep@kopyto.com ("Issuer").

These Terms and Conditions form an integral part of the Gift Card sales agreement concluded between the Issuer and the Customer.

II. DEFINITIONS

For the purposes of these Terms and Conditions, it is assumed that the following terms and expressions written with a capital letter have the meanings assigned to them below, unless the content of the provisions clearly indicates a different understanding of a given term:

  • Gift Card – a voucher in digital form (PDF) or any other form permitted by the Issuer, enabling purchases of Goods up to the amount of available funds.
  • Customer – a person who purchases a Gift Card.
  • Consumer – a natural person performing a legal transaction not directly related to their business or professional activity.
  • Entrepreneur with Consumer Rights – a Customer who is a natural person concluding a contract directly related to their business activity, where the content of that contract indicates that it is not of a professional nature for them.
  • User – the current holder and bearer of the Gift Card.
  • Goods – product(s) offered for sale in the Store.
  • Transaction – the act of redeeming the Gift Card, consisting in exchanging the funds accumulated on the Gift Card for Goods.
  • Store – the online store www.kopyto.com.

III. PURCHASE AND ISSUANCE OF THE GIFT CARD

Gift Cards may be purchased in the Store.

The Customer may purchase a Gift Card in the denominations currently available in the Store.

The purchase of a Gift Card is possible exclusively in Polish currency (PLN).

The Gift Card is delivered to the Customer by email. The Gift Card takes the form of a PDF file containing a unique code.

Payment for the Gift Card may be made using payment methods available from the Issuer.

Payment for a Gift Card may not be made using another Gift Card.

Gift Cards may not be purchased using discounts or promotions.

A Gift Card within the meaning of applicable law is not an electronic payment instrument, nor is it an electronic payment card.

A Gift Card may not be exchanged for cash, in whole or in part, and is non-refundable.

The Consumer and the Entrepreneur with Consumer Rights have the right to withdraw from the distance agreement for the purchase of a Gift Card within 30 days of the date of purchase of the Gift Card; however, after the statutory 14-day period has elapsed, withdrawal is possible only provided that the Gift Card has not been used for any Transaction.

Within 14 days of receiving the declaration of withdrawal from the agreement, the Issuer shall refund to the Customer all payments made by the Customer to the Issuer in connection with the issuance of the Gift Card.

The refund shall be made using the same payment method as that used by the Customer, unless the Customer expressly agrees to a different method of refund that does not entail any costs for them.

The right to withdraw from the Gift Card purchase agreement does not apply if the Gift Card has been used prior to the expiry of the withdrawal period.

The purchase of a Gift Card consists in the transfer of funds towards future purchases and does not constitute the purchase of Goods.

The Issuer documents the purchase of the Gift Card in accordance with applicable law.

At the Customer's request, the Issuer shall issue a document confirming payment for the Gift Card in the form provided for by applicable law.

IV. VALIDITY PERIOD AND TERMS OF USE

The Gift Card may be redeemed exclusively in the Store www.kopyto.com.

The Gift Card is valid from the date of its purchase (no additional activation by the User is required) for 12 months from the date of its purchase.

The Card enables Transactions to be made on one or more occasions, up to the amount of available funds.

If the price of Goods exceeds the amount of funds available on the Gift Card, the User pays the difference using another accepted payment method.

Unused funds may not be withdrawn in cash or refunded, subject to mandatory provisions of law.

The Gift Card is a bearer card and may be transferred to a third party, who from the moment of transfer becomes its User.

The Issuer shall not be liable for Gift Cards that have been lost or destroyed. In the event of loss (including theft), damage or destruction of the Gift Card, the Gift Card may not be restored.

The Issuer may refuse to redeem the Gift Card in the event of:

  • insufficient funds on the Card;
  • reasonable suspicion of unauthorised use, fraud or breach of law;
  • a technical failure preventing the completion of the Transaction.

When redeeming the Gift Card, if the value of the Goods received is lower than the current value of the Gift Card, the User is not entitled to receive the unused portion of the funds accumulated on the Gift Card in cash. The remaining unused value on the Gift Card shall remain available to the User during the validity period of the Gift Card.

V. RETURNS AND COMPLAINTS OF GOODS

In the event of the return of Goods purchased using a Gift Card, the Issuer shall refund the funds by reloading the Card.

If the Card has expired or is about to expire shortly, the Issuer – with the User's consent – may make the refund in another form in accordance with the provisions of the Consumer Rights Act.

Complaints relating to Goods shall be handled in accordance with the Returns and Complaints Policy in force at Z Kopytem sp. z o. o.

VI. COMPLAINTS CONCERNING THE GIFT CARD

The User has the right to submit a complaint concerning the functioning of the Gift Card, in particular in the event of unauthorised debiting of the Card balance, problems with its activation, reading its value or completing a transaction using the Gift Card.

A complaint may be submitted in any form.

A complaint may be submitted by the Customer, for example:

  • in writing to the Issuer's correspondence address;
  • electronically by email to: returns@kopyto.com.

The complaint should include the User's name and surname, contact details, a description of the circumstances giving rise to the complaint and the specific claim associated with the complaint. It is recommended to attach documents or information helpful in its consideration.

If the complaint submitted requires supplementation, the Issuer shall ask the User to provide the missing data or documents. The complaint shall be considered upon receipt of the complete information necessary for its resolution.

The Issuer shall respond to the complaint within 30 days of receipt of the correctly submitted and complete complaint. The User shall be informed of the outcome of the complaint by electronic mail to the email address provided. In the event of rejection of the complaint, the Issuer shall provide reasons for the decision.

In the event of a complaint being upheld, the Issuer shall issue the User with a new Gift Card of a value corresponding to the funds accumulated on the Gift Card subject to the complaint, with the original validity period preserved.

VII. PERSONAL DATA

All personal data provided by you in the course of the process of purchasing and using the Gift Card are processed by Z Kopytem sp. z o. o., which acts as the Controller of the data.

VIII. AMENDMENT OF THE TERMS AND CONDITIONS

The Issuer may amend these Terms and Conditions for legitimate reasons, which shall include, inter alia:

  • the necessity to adapt the content of the Terms and Conditions to changes in applicable law;
  • the obligation to comply with decisions, recommendations or interpretations issued by competent public authorities or courts;
  • the need to correct obvious errors, inaccuracies or to supplement editorial omissions;
  • the updating of the Issuer's identification or contact details, as well as changes to the website addresses indicated in the Terms and Conditions;
  • a change in the manner in which Gift Cards operate, in particular the extension or modification of their functionalities;
  • the necessity to ensure the safety of Users or to counteract abuse.

All amendments to the Terms and Conditions shall enter into force on the date of publication of the updated version of the Terms and Conditions on the Store's website and shall apply to Gift Cards purchased after that date.

Amendments to the Terms and Conditions shall not affect the vested rights of Customers who purchased a Gift Card prior to the entry into force of the amendments, unless the amendment is beneficial to the User or results from provisions of law.

The Issuer shall inform Customers holding active Cards of material amendments by means of a message sent to their email addresses, where available.

IX. DISPUTE RESOLUTION

These Terms and Conditions shall be governed by Polish law.

In the event of a dispute arising, Consumers shall have the option of using both court proceedings and out-of-court dispute resolution methods, in particular by:

  • submitting a request to the competent Regional Inspectorate of Trade Inspection to conduct out-of-court consumer dispute resolution proceedings, in accordance with the Act of 23 September 2016 on out-of-court consumer dispute resolution (contact information available on the UOKiK website: https://uokik.gov.pl/wiih);
  • referring the matter to the Permanent Consumer Arbitration Court operating at the relevant Regional Inspectorate of Trade Inspection (list of courts and contact details: https://uokik.gov.pl/wazne_adresy.php#faq596);
  • obtaining assistance from the Municipal Consumer Ombudsman in the area of consumer rights protection (https://uokik.gov.pl/rzecznicy).

The EU ODR platform, enabling online consumer dispute resolution, is also available at: https://ec.europa.eu/consumers/odr.

The use of the above out-of-court dispute resolution methods is voluntary and requires the joint agreement of both parties.

If you are not acting as a Consumer, all disputes with the Issuer shall be resolved by the court having territorial jurisdiction over the registered office of Z Kopytem sp. z o. o.

X. FINAL PROVISIONS

These Terms and Conditions are available on the website www.kopyto.com.

These Terms and Conditions are in force from 13 March 2026.

In matters not regulated by these Terms and Conditions, the generally applicable provisions of law shall apply, in particular the Civil Code and the Consumer Rights Act.
