Terms and conditions for the "Extended return period" service
TERMS AND CONDITIONS FOR THE "EXTENDED RETURN PERIOD" SERVICE
in the online store www.kopyto.com
§ 1. General Provisions
- These terms and conditions (hereinafter: "Extended Return Period T&C") set out the rules for ordering, providing and settling the additional service under the name "Extended return period of up to 40 days" (the "Service"), available in the online store operating at www.kopyto.com ("Store").
- The Service is provided by Z Kopytem spółka z ograniczoną odpowiedzialnością with its registered office in Sopot, ul. Władysława Łokietka 46/1, 81-736 Sopot, Poland, KRS: 0000617134, NIP: 5851474404, REGON: 364408532, BDO: 000635824, email address: sklep@kopyto.com ("Seller").
- These Extended Return Period T&C form an integral part of the Terms and Conditions of the kopyto.com online store available at https://kopyto.com/policies/terms-of-service ("Store Terms and Conditions"). In matters not regulated by these Extended Return Period T&C, the provisions of the Store Terms and Conditions and generally applicable law shall apply.
- The Service constitutes a voluntary and paid extension of the standard right of withdrawal from the Sales Agreement available to the Consumer pursuant to Art. 27 of the Act of 30 May 2014 on Consumer Rights (consolidated text: Journal of Laws of 2024, item 1796, as amended; the "Consumer Rights Act").
- The Service is optional and may be selected exclusively at the time of placing an Order.
§ 2. Definitions
For the purposes of these Extended Return Period T&C, capitalised terms have the meanings assigned to them below or — where not defined below — the meanings assigned to them in the Store Terms and Conditions.
- Service – a service consisting in granting the Customer who is a Consumer an additional right to withdraw from the Sales Agreement within an extended period of up to 40 days from the date of taking possession of the Product, in place of the standard 14 days.
- Customer – a natural person, legal person or organisational unit making a purchase in the Store, as defined in the Store Terms and Conditions.
- Consumer – a Customer who is a natural person performing a legal transaction not directly related to their business or professional activity; an Entrepreneur with Consumer Rights, as defined in the Store Terms and Conditions, shall also be regarded as a Consumer.
- Sales Agreement – a distance agreement for the sale of a Product concluded between the Seller and the Customer, on the terms set out in the Store Terms and Conditions.
- Product – a movable item that is the subject of the Sales Agreement concluded through the Store, in respect of whose purchase the Service was acquired.
- Business Day – a day of the week from Monday to Friday, excluding public holidays in the territory of the Republic of Poland.
§ 3. Scope of the Service
- Under the Service, a Customer who is a Consumer acquires the right to withdraw from the Sales Agreement within up to 40 days from the date of the Product being taken into possession by the Customer or by a third party designated by the Customer other than the carrier.
- The Service covers exclusively the extension of the deadline for withdrawal from the Sales Agreement. All other conditions for the exercise of the right of withdrawal — including the rules for the refund of payments, the costs of returning the Product, the manner of submitting the declaration of withdrawal, and liability for any reduction in the value of the Product — remain unchanged and are governed by the provisions of the Consumer Rights Act, the Store Terms and Conditions, and the Returns and Complaints Policy.
- The Service applies exclusively to the Order in connection with which it was purchased. It cannot be assigned to other Orders or Products.
- The Service does not modify the rules governing the Seller's liability for the conformity of the Product with the Sales Agreement (complaints) — these are governed by the provisions of the Consumer Rights Act, the Store Terms and Conditions, and the Returns and Complaints Policy.
- The Service may only be used by Customers making a purchase as Consumers or as Entrepreneurs with Consumer Rights.
§ 4. Conditions for Purchasing the Service
- The Service may be purchased exclusively during the placement of an Order, by selecting the "Extended return period" option in the Order form.
- The cost of the Service is PLN 19 (nineteen Polish zlotys) gross and is added to the Order value. The fee is displayed separately at the Order summary stage prior to its final confirmation.
- Purchase of the Service takes effect upon the conclusion of the Sales Agreement, in accordance with the terms set out in the Store Terms and Conditions.
- The terms of provision of the Service are presented to the Customer each time before the final confirmation of the Order.
§ 5. Right of Withdrawal from the Service Agreement
- A Customer who is a Consumer has the right to withdraw from the service agreement on the terms set out in this section.
- The Service consists in granting the Customer an additional right (extension of the withdrawal period) and is performed by the Seller without delay upon conclusion of the Sales Agreement — at the moment the Customer is granted that right. By reason of the nature of the Service, its full performance occurs prior to the expiry of the statutory 14-day withdrawal period.
- If the Customer gave express consent to the commencement of the provision of the Service before the expiry of the withdrawal period and was informed of the loss of the right of withdrawal upon full performance of the Service — the Consumer shall not be entitled to withdraw from the service agreement after its full performance by the Seller, in accordance with Art. 38(1) of the Consumer Rights Act.
- The consent referred to in paragraph 3 above is given by the Customer by actively ticking a separate
checkbox in the Order form, bearing the following content:
"By choosing this service, you consent to the immediate commencement of the 'Extended return period of up to 40 days' service before the expiry of the 14-day withdrawal period and acknowledge that upon full performance of the Service by the Seller, you will lose your right to withdraw from the agreement in respect of this Service."
§ 6. Non-Refundability of the Service Fee
- Upon full performance of the Service — i.e. upon the Customer being granted the right to the extended return period — the Service fee is non-refundable, subject to mandatory provisions of law.
- The non-refundability of the Service fee also applies in cases of:
- the Customer withdrawing from the Sales Agreement for the Product — the Customer's use of the Service is not conditional on them actually returning the Product;
- the Customer failing to return the Product within the period available to them.
§ 7. Rules for Returning the Product under the Service
- A Customer who has purchased the Service may withdraw from the Sales Agreement for the Product within up to 40 days from the date of taking possession of the Product, by submitting a declaration of withdrawal before the expiry of that period.
- To comply with the 40-day deadline, it is sufficient to send the declaration of withdrawal before its expiry.
- After submitting the declaration of withdrawal, the Customer is obliged to return the Product to the Seller within 14 days of the date of submission of that declaration.
- The declaration of withdrawal may be submitted:
- in writing to the Seller's address: Z Kopytem sp. z o.o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland;
- by email to: returns@kopyto.com.
- The Customer may use the withdrawal form available in the Store Terms and Conditions, but this is not mandatory.
- The Product to be returned must be returned in an unimpaired condition, not exceeding what is necessary to determine its nature, characteristics and functioning. The Customer is liable for any reduction in the value of the Product resulting from using it beyond that scope.
- The Seller recommends that the Product be returned in a complete condition — with tags, in its original packaging (where possible), without signs of use beyond what is necessary to determine its characteristics and functioning. The foregoing constitutes a recommendation only and is not a condition for the validity of withdrawal.
- The Customer shall bear the direct costs of returning the Product, unless the Seller has expressly agreed to cover them.
- The Seller shall refund all payments for the Product, including delivery costs (with the exception of additional costs arising from the choice of a more expensive delivery method than the cheapest available), no later than within 14 days of receipt of the Product or proof of its dispatch. The refund shall be made using the same payment method as that used by the Customer, unless the Customer expressly agrees to a different method of refund.
- The detailed rules regarding the return of Products are governed by the Returns and Complaints Policy, which forms an integral part of the Store Terms and Conditions.
§ 8. Complaints Concerning the Service
- The Customer has the right to submit a complaint concerning the non-performance or improper performance of the Service.
- A complaint may be submitted in any form, in particular:
- in writing to the Seller's correspondence address: Z Kopytem sp. z o. o., ul. B. Spiechowicza 36, 43-300 Bielsko-Biała, Poland;
- by email to: sklep@kopyto.com.
- The complaint should include the Customer's details, the Order number and a description of the objections raised. It is recommended to attach confirmation of the Order or payment.
- The Seller shall handle the complaint without undue delay, no later than within 14 days of its receipt. Failure to respond within that period shall constitute acceptance of the complaint by the Seller.
§ 9. Final Provisions
- These Extended Return Period T&C are available on the website www.kopyto.com.
- The Seller reserves the right to amend these Terms and Conditions for legitimate reasons, in particular in the event of changes to applicable law or changes to the terms of provision of the Service. Amendments shall not affect Services acquired prior to the date on which the amendments enter into force.
- The Seller shall notify Customers of any amendment to these Extended Return Period T&C by publishing the updated version on the Store's website.
- In matters not regulated by these Extended Return Period T&C, the provisions of the Store Terms and
Conditions and generally applicable law shall apply, in particular:
- the Consumer Rights Act;
- the Act of 23 April 1964 – Civil Code (consolidated text: Journal of Laws of 2025, item 1071, as amended);
- the Act of 18 July 2002 on the provision of services by electronic means (consolidated text: Journal of Laws of 2024, item 1513, as amended).
- These Extended Return Period T&C are in force from 14 May 2026.
